1. Introduction

These Terms of Service ("Agreement") govern your use of Syrup Hosting's web hosting, email hosting, and graphic design services. By using our services, you ("Client") agree to comply with these terms. Syrup Hosting reserves the right to suspend or terminate services for any violation of this Agreement.

All services are intended for lawful use only, in compliance with Zimbabwean national laws and regulations. Syrup Hosting operates as a neutral provider of Internet and design services and reserves the right to refuse, suspend, or cancel services for inappropriate use.

2. Ordering and Service Usage

By ordering services, you authorize Syrup Hosting to set up your account and charge the provided payment method. Web and email hosting services are for end-users only and may not be subleased, sold, or transferred to third parties. Graphic design services are provided per agreed project specifications. Services are delivered at a professional level, conforming to industry standards and applicable Zimbabwean laws. Syrup Hosting disclaims all warranties of merchantability or fitness for a particular purpose unless expressly stated.

Clients are responsible for regularly backing up their data. Syrup Hosting is not liable for the deletion of files, intentional or unintentional. Web and email hosting services do not include default backups, and clients are encouraged to enable automatic backups where available.

3. Authorization of Charges

Syrup Hosting bills for services, with payment due within seven (7) days of invoice issuance. Clients are notified via email when payment is due, and invoices may be settled via mobile money, bank transfer, or other approved methods. Non-payment within the due date triggers a seven (7) day grace period, after which services may be suspended. Continued non-payment may result in account termination. Clients are responsible for ensuring valid contact details are provided for billing notifications.

4. Content Restrictions

All services must be used for lawful purposes only, compliant with Zimbabwean laws. Prohibited content includes, but is not limited to:

  • Copyrighted or trademarked material without permission
  • Pirated software, hacker programs, cracks, or illegal media files
  • Unregistered financial or investment platforms
  • Unlicensed banking, money transfer, or pharmaceutical sales
  • Adult content, unless compliant with applicable regulations
  • Content promoting violence, hate speech, or illegal activities
  • Phishing or scam websites
  • File archives on web hosting (use designated storage solutions)

Syrup Hosting reserves the right to disable material deemed unacceptable, illegal, or subject to takedown notices. Unresolved complaints may lead to service suspension.

5. Web and Email Hosting Restrictions

Clients may install applications, but Syrup Hosting may disable those that unreasonably affect server operations. Prohibited on web hosting:

  • Video streaming sites, file/email archives, or excessive resource-heavy applications
  • Accounts using more than 20% of server resources or exceeding 400,000 inodes

Storage fees may apply for excessive resource usage. Email hosting must comply with anti-spam regulations.

6. Anti-Spam Policy

Syrup Hosting prohibits the use of its servers for spam or misuse of email services. Spam includes unsolicited mass emails or actions generating abuse complaints. Email lists must be double opt-in, include clear removal instructions, and process unsubscribe requests within 24 hours. Excessive complaints may result in email service restrictions or account termination.

7. Service Abuse

Any attempt to undermine or harm Syrup Hosting’s servers or clients is prohibited and may result in immediate service termination without refund. Syrup Hosting is the sole arbiter of violations.

8. Support Policy

Syrup Hosting provides technical support, aiming to respond within 1-3 hours, though no guarantee is made. Support is limited to covered technical issues for hosting and general inquiries for graphic design services. Third-party software issues should be directed to the software provider. Accounts may be restricted for interactions outside acceptable conduct standards.

9. Indemnification

Clients agree to indemnify Syrup Hosting against liabilities arising from services provided, products sold, or intellectual property infringements. Syrup Hosting assumes no liability for client actions or omissions causing third-party claims.

10. Disclaimer

Syrup Hosting is not liable for damages suffered by clients or their businesses. No warranties are provided for service disruptions due to vandalism, theft, outages, or force majeure events. Syrup Hosting is not responsible for consequential or punitive damages.

11. Data Protection

Syrup Hosting complies with the Cyber and Data Protection Act [Chapter 12:07] to protect client data processed or stored through our web and email hosting services. We implement reasonable security measures to safeguard data against unauthorized access, loss, or breaches. Clients are responsible for maintaining secure account credentials and backing up their data regularly. Syrup Hosting will notify clients of any data breaches as required by law but is not liable for losses arising from client negligence or failure to implement backups. Graphic design files provided by clients must comply with intellectual property laws, and Syrup Hosting is not responsible for verifying client ownership of such materials.

12. Term and Termination

This Agreement continues until canceled by either party. Syrup Hosting may terminate with cause upon notification or immediately for breaches. Services may be terminated if supporting programs or facilities are disrupted.

13. Refunds

Refunds are available for web and email hosting accounts within 7 days of signup for annual plans only. No refunds for monthly plans. No refunds are offered for graphic design services once work has begun. Refunds are subject to review and not available for accounts violating these Terms of Service. Cancellations stop future charges but forfeit prior payments.

14. Service Renewal and Expiry

Syrup Hosting services do not renew automatically. Clients are notified via email or WhatsApp at least seven (7) days before the service expiry date, prompting payment to renew services. Any agreement to extend the payment date or retain data post-termination must be acknowledged by Syrup Hosting in writing, defined as email or WhatsApp message. If payment is not received by the expiry date or an agreed extended date, the account is suspended for seven (7) days, during which services are inactive. Failure to renew or make an arrangement within the suspension period results in immediate account termination, and all client data is deleted permanently and non-recoverably. Syrup Hosting is not liable for data loss following suspension or termination. 15. Governing Law

This Agreement is governed by Zimbabwean law, with disputes resolved in Zimbabwean courts. Invalid provisions do not affect the enforceability of other terms.
